In the society that we currently live in there are more than enough specific instances of individuals finding overlap in business. Sometimes a company will have the same processes, customers, ideals, and etc. as another company and overall that isn't exactly a problem. Other times it can become a fairly serious problem in nature as one company might have the same name or brand as another company. This can be extremely tricky to identify, and once a company has gone through the proper trademark registration they can either hope that no one interferes with their mark, or they can actually be proactive about it and stay on top of the situation.
However, what happens when an individual finds that someone else is violating the terms of their
trademark registration? What does an individual do when they realize that they have had something which is clearly registered to them be in use by another company? Can it actually be taken care of just like that? Or would an individual have to navigate through the proper channels and hope that they can actually end up taking care of business the right way?
In other words, even if you have the law on your side and you know (or think) that you are in the right, what do you do to ensure that your trademark is protected?
You could spend the time to continue finding all of the information possible. You could take time away from your day to day business operations and activities and hope that you are using your time wisely to read up on the laws. Or, you could think about bringing in the services of an individual (or a set of individuals) that actually specialize in this sort of thing each and every day. Maybe it would just simply make more sense to speak with the professionals and see how they would go about protecting your name and your image?
What's even more important is the process itself. What if you thought you knew what you were doing and made a mistake along the way? The process can be very tricky, and by doing something as simple as signing the wrong form, checking a box in the wrong spot, or even going about the process without performing every aspect of due diligence ahead of time, then what can happen? The truth is a lot. You would probably hate to ruin your entire case and jeopardize your trademark registration and rights all because you wanted to save a few dollars up front and avoid getting a trademark expert on your team.
Overall, you need to be sure that your mark is actually protected. If you have already gone about the entire process of trademark registration then you would only understand how much work was necessary just to get this far; work that probably can't be replicated from a creativity point of view. So instead of sitting around and letting others go ahead and ruin your business or your reputation, why not bring in someone who is actually going to help you enforce your property and rights.
